Terms of Service

Effective: July 13, 2026

By using Converge ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

Converge is a self-hosted or cloud-hosted ad conversion tracking and refund write-back platform. It helps advertisers send conversion events (purchases, refunds, etc.) back to Meta, TikTok, Google, and other ad platforms in real time, to optimize ad delivery algorithms.

The Service does not place ads, manage ad spend, or control bidding logic. It is a data pipeline -- forwarding real business events through official ad platform APIs.

2. Account Registration & Security

1. You must be at least 18 years old (or the age of majority in your jurisdiction).
2. You must provide accurate registration information and are responsible for all activity under your account.
3. Do not share credentials. For multi-user access, upgrade to a plan that supports it.
4. You are responsible for maintaining password confidentiality. Notify us immediately of unauthorized access.

3. Acceptable Use

You agree not to use the Service for:

• Tracking or sending conversion data for illegal goods/services (drugs, weapons, human trafficking, counterfeits, etc.)
• Distributing malware, viruses, or conducting denial-of-service attacks
• Violating any ad platform (Meta, TikTok, Google, etc.) terms of service
• Sending fraudulent conversion events (click spam, conversion fraud)
• Reverse engineering or unauthorized access to proprietary code (open-source edition excepted, see Section 8)

We reserve the right to suspend or terminate Service for violations without prior notice.

4. Payment & Subscription

1. Pricing is as published on the Pricing page. Prices may change with at least 14 days email notice.
2. All fees are in USD. You are responsible for currency conversion and bank fees.
3. Subscriptions auto-renew monthly unless cancelled before the renewal date.
4. Refund policy: monthly subscriptions -- full refund within 48 hours of purchase. Annual subscriptions -- prorated refund based on months used (partial month counts as full).
5. No refunds for termination due to Terms violation.

5. Service Availability

Cloud-hosted: we aim for 99.5%+ monthly uptime but provide no SLA guarantee (Enterprise plans may negotiate a separate SLA).

Self-hosted: availability depends entirely on your infrastructure. We are not responsible for downtime, data loss, or performance issues on self-hosted instances.

6. Limitation of Liability

IMPORTANT: The Service is provided "AS IS" without warranty of any kind.

• In no event shall Converge be liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, data loss, wasted ad spend).
• Our total liability shall not exceed the total fees you paid to Converge in the twelve (12) months preceding the claim.
• You understand that ad platform algorithm behavior is beyond our control. Sending refund data may improve but does not guarantee lower ad costs or higher ROAS.

7. Data & Privacy

You are responsible for all data collected and processed through the Service. You must:

• Comply with all applicable data protection laws (GDPR, CCPA, etc.)
• Provide lawful privacy notices to your end users about conversion tracking
• Obtain end-user consent where required (cookie consent, CAPI data consent)

Converge acts as a data processor (self-hosted) or data controller (cloud). See our Privacy Policy.

8. Intellectual Property & Open Source

Converge uses an Open Core model:

• The core tracking engine is open-source under the MIT license. You may use, modify, and distribute it.
• Pro/Enterprise modules (Smart Rotation, White-label, Visual Funnel, etc.) are proprietary.
• "Converge" name and logo are trademarks. Do not use without permission.

You retain full ownership of your data. We claim no ownership over your data.

9. Termination

You may stop using the Service at any time. Cloud users may cancel via account settings. Self-hosted users simply stop running the software. We are not responsible for recovering deleted data after termination. See Privacy Policy for data retention and export terms.

10. Changes to Terms

We may update these Terms. Material changes will be announced via email and on the website at least 14 days in advance. Continued use after changes means acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA. Disputes shall first be resolved through good-faith negotiation; if unresolved, submitted to courts of competent jurisdiction in Delaware.
